CVOR AND HIGHWAY TRAFFIC ACT

The Highway Traffic Act is a set of judicial rules that govern the operation of motor vehicles on both provincial and municipal roads in Canada. COMMERCIAL VEHICLE OPERATOR REGISTRATION (CVOR)

According to the Ministry of Transportation, all commercial vehicles must be driven by a licensed driver who has earned the CVOR. CVOR is an Ontario-based registration system that monitors the safety of truck and bus operations. A commercial vehicle operator is an individual or corporation responsible for the safe transportation of goods or passengers in a truck or bus, including the conduct of the driver, the technical condition of the vehicle, and the conduct of the driver.

A CVOR certificate is needed to operate trucks with a recorded plated weight (or actual weight) of more than 4,500 kilograms (9,920 pounds) and buses with a seating capacity of 10 or more passengers. This law refers to vehicles registered in Ontario, the United States, or Mexico that operate within the province. A carrier must fill out an application for a CVOR certificate called "Commercial Vehicle Operator's Registration." The submission and issuance of an initial CVOR certificate will be charged a fee of $255.

CVOR EXCEPTIONS

  • Ambulances are available for hire.
  • Vehicles from the fire department
  • Casket wagons and hearses
  • RVs are mobile homes.

PERSONAL USE EXEMPTIONS

  • Buses that are primarily used for personal reasons
  • Commercial motor vehicles leased for no more than 30 days for personal use (e.g., transporting one's own household goods) or used for passenger transportation without reimbursement.
  • Most pick-up trucks are used for personal reasons (without compensation) and are not towing a trailer with freight, supplies, or equipment that would usually be used for commercial purposes.

PERMIT EXEMPTIONS

  • In-Transit vehicles are commercial motor vehicles that operate under the authority of an In-Transit permit.
  • Vehicle manufacturers, dealers, or businesses repair, road test, customize, or change vehicles have temporary permits and number plates.

The CVOR record contains the following information:

  • Carrier information (kilometric travel, violation rates, safety rating)
  • Collisions that must be recorded
  • Convictions against the operator and/or all of the drivers who work under your CVOR certificate.
  • Both checks of the operator's fleet, whether or not they find any flaws.

From the date of the offense, all things remain on the operator's CVOR record for a period of five years.

If an operator's record becomes inappropriate, the ministry can issue a warning letter, perform an audit, or call a meeting with the operator to discuss the record. The ministry can enforce penalties, such as the cancellation or suspension of the CVOR certificate, plates, and permits if the operator's record does not improve.
