Workers Requirement To Claim And Consent

Under the insurance scheme, workers who are entitled to coverage but have not fulfilled the claim and approval conditions can only receive one bonus payout (up to two weeks of loss of earnings benefits). If the worker meets the criteria, no further benefits are offered. Staff must make an insurance application as soon as possible after an accident. They must also agree to the disclosure of details about their functional capacities, which is given by the treating health professional. A lawsuit must be made within six months of an  accident  or within six months of the worker's knowledge of the condition in the case of an occupational disease. If the WSIB believes it is necessary, it will extend the six-month deadline or waive the dual requirement entirely. The government does not offer compensation because it believes it is just to do so if the worker does not file an application for benefits or agree to the disclosure of functional abilities details within the six-month deadline.
